ARTICLE 3 – WEBSITE ACCESS AND CUSTOMER ACCOUNTS

Access to the website is limited to persons who have the legal capacity required to use its services and, where applicable, enter into a contract.

Certain features may require you to create an account or provide personal information. You agree to provide information that is accurate, complete and up to date.

You are responsible for maintaining the confidentiality of your login details and for all activity carried out through your account. If you become aware of any unauthorised use, please contact us immediately.

ARTICLE 4 – PRODUCT INFORMATION

Bordereau Photography makes every effort to present the artworks, sizes, finishes, dimensions and prices as accurately as possible.

However, colours may vary slightly depending on the screen, its calibration, brightness and display settings. This technical variation does not restrict the customer’s rights where a product is defective or does not conform to the order.

The photographs are produced to order by our laboratory partner, WhiteWall, according to the configuration selected by the customer.

We may change product descriptions, prices or availability before an order is confirmed. The conditions applicable to an order are those displayed and accepted when the order is placed.

ARTICLE 5 – ORDERS AND PAYMENT

Confirming an order creates an obligation to pay. An order is considered accepted once an electronic confirmation has been issued and payment has been validated.

We may refuse or cancel an order for a legitimate reason, including product unavailability, an obvious pricing error, payment failure, suspected fraud or inability to deliver. Where this occurs, any amount already received for the cancelled order will be refunded.

Production, shipping, delivery, return and refund arrangements are set out in the corresponding policies available in the website footer.

ARTICLE 6 – INTELLECTUAL PROPERTY

The photographs, images, text, logos, graphics, videos, visual elements and other content displayed on the website are protected by copyright and other intellectual property laws.

Unless prior written permission has been obtained from Maxime Bordereau, you may not copy, reproduce, download, modify, publish, distribute, sell, commercially exploit or publicly use this content.

Purchasing a physical photographic print does not transfer any copyright, reproduction right or exploitation right relating to the image. The purchaser acquires ownership only of the physical copy ordered.

Requests concerning licensing, publication or professional use must be sent to maximebordereau@gmail.com.

ARTICLE 7 – PROHIBITED USES

You agree not to use the website:

• for any unlawful, fraudulent or malicious purpose;
• to infringe the rights of Bordereau Photography or any third party;
• to transmit viruses, malicious software or harmful content;
• to attempt to bypass the website’s security measures;
• to collect personal data without authorisation;
• to reproduce or extract content or photographs on a large scale;
• to disrupt the normal operation of the website or its services.

We may restrict or suspend access to the website in the event of abusive use or a breach of these Terms, in accordance with applicable law.

ARTICLE 8 – THIRD-PARTY LINKS AND SERVICES

The website may contain links to or provide access to services operated by third parties, including Shopify, WhiteWall, payment providers, carriers and social media platforms.

These third parties have their own terms and privacy policies. Bordereau Photography is not responsible for the content or operation of an independent third-party website.

This provision does not restrict Bordereau Photography’s responsibility for the proper fulfilment of orders placed directly through its online store.

ARTICLE 9 – RELATIONSHIP WITH SHOPIFY

The online store is hosted and technically operated using the Shopify platform.

Any sale made through the website is concluded directly between the customer and Maxime BORDEREAU, trading as Bordereau Photography. Shopify is not the seller of the artworks offered through the store.

ARTICLE 10 – PERSONAL DATA AND COOKIES

Personal data collected when the website is used or an order is placed is processed in accordance with our Privacy Policy, available in the website footer.

Certain data is also processed by Shopify and by service providers required for payment, production, delivery and operation of the online store.

Information concerning cookies and consent choices is provided through the website’s cookie management tool.

ARTICLE 11 – WEBSITE AVAILABILITY AND SECURITY

We make reasonable efforts to keep the website accessible and secure. Access may nevertheless be temporarily interrupted due to maintenance, updates, technical incidents or circumstances beyond our reasonable control.

We do not guarantee that the website will operate continuously or without interruption. This provision does not restrict any rights relating to an order that has already been concluded.

ARTICLE 12 – LIABILITY

Bordereau Photography is responsible for the proper fulfilment of orders concluded through the website in accordance with applicable law.

We are not responsible for damage resulting from fraudulent use of the website, inaccurate information provided by a user or an external event that could not reasonably have been avoided.

Nothing in these Terms limits or excludes statutory guarantees, the right of withdrawal where applicable, or any other mandatory rights granted to consumers.

ARTICLE 13 – CHANGES TO THESE TERMS

We may amend these Terms of Use to reflect changes to the website, our services or applicable law.

The applicable version is the version available on the website on the date it is used. Any change affecting an order already concluded will not apply retroactively unless required by law or agreed with the customer.

ARTICLE 14 – GOVERNING LAW

These Terms are governed by French law.

For consumers residing in another country, this choice does not deprive them of any mandatory consumer protection provisions applicable under the law of their country of residence.

In the event of a dispute, the customer is encouraged to contact Bordereau Photography first in order to seek an amicable solution. Mandatory information concerning consumer mediation and the jurisdiction of the courts will be set out in the Terms and Conditions of Sale.
